Terms of Service

1. Acceptance of Terms

By accessing or using the Nomacore API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Nomacore provides a name intelligence API that predicts demographic attributes (country of origin, gender, ethnicity, and age) based on personal names. The Service is provided on an "as is" and "as available" basis.

3. Account Registration

To use the Service, you must:

  • Create an account with a valid email address
  • Verify your email address
  • Maintain the security of your account credentials
  • Be at least 18 years of age

You are responsible for all activity that occurs under your account.

4. API Keys and Usage

4.1 API Key Security

Your API keys are confidential. You must not share, publish, or expose your API keys. If you believe an API key has been compromised, revoke it immediately through the dashboard.

4.2 Usage Limits

Your usage is subject to the limits of your subscription tier:

  • Free Tier: 100 API credits per month
  • Pro Tier: 10,000 API credits per month

Credits reset at the beginning of each calendar month. Unused credits do not roll over.

4.3 Rate Limiting

We may impose rate limits to ensure fair usage and service stability. Excessive requests may be throttled or blocked.

5. Acceptable Use

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Discriminate against individuals based on predicted attributes
  • Make decisions that have legal or significant effects on individuals solely based on API predictions
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to the Service
  • Reverse engineer, decompile, or attempt to extract the underlying models
  • Resell or redistribute the Service without authorization

6. Accuracy and Limitations

Important: The predictions provided by the Service are probabilistic estimates based on statistical patterns. They are NOT definitive statements about any individual.

  • Predictions may be inaccurate for any given individual
  • Results should not be used as the sole basis for decisions affecting individuals
  • The Service reflects statistical patterns and may contain biases present in training data
  • Ethnicity predictions are based on US Census data and may not apply to other populations
  • Age predictions are based on US name popularity trends

7. Payment Terms

For paid subscriptions:

  • Fees are billed monthly in advance
  • All fees are non-refundable unless otherwise required by law
  • We may change pricing with 30 days notice
  • Failure to pay may result in service suspension

8. Intellectual Property

The Service, including its algorithms, models, and documentation, is owned by Nomacore and protected by intellectual property laws. You may not copy, modify, or create derivative works based on the Service.

You retain ownership of any data you submit to the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOMACORE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Nomacore and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination:

  • Your right to use the Service ceases immediately
  • Your API keys will be revoked
  • We may delete your account data after a reasonable period

13. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use after changes constitutes acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
